Notes on Lunchbox Notes are private: a note goes only to the people it is sent to, and a share page shows it only to whoever has its link. Still, a note can hold a photo or a drawing that belongs to someone else. If you think something on Lunchbox Notes uses your work without your permission, tell us and we will look at it.
Our copyright agent
Notices of claimed infringement go to the copyright agent of Sailstead LLC, which runs Lunchbox Notes:
- Copyright Agent, Sailstead LLC, Las Vegas, Nevada, USA
- Email: contact@lunchboxnotes.app, with “Copyright notice” in the subject
If you need a postal address for your notice, ask at the email above and we will send it.
What to send us
Under the US Digital Millennium Copyright Act (17 U.S.C. § 512), a notice has to include:
- your physical or electronic signature, as the owner of the work or as someone allowed to act for the owner;
- what the work is that you think was copied (a photo, a drawing, a text), or a list of works if there are several;
- where it is on Lunchbox Notes, so we can find it: a share page’s link, or whose note it is and when it was sent (a screenshot helps);
- how to reach you: your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use is not allowed by the owner, the owner’s agent or the law;
- a statement that what your notice says is accurate and, under penalty of perjury, that you are the owner or allowed to act for the owner.
You don’t need a Lunchbox Notes account to send one. A notice that leaves out one of these may take us longer, and we may write back to ask for what is missing.
What we do
We confirm that we received your notice, and look at it within 3 working days. If it is complete, we take the note or the picture down: nobody can see it on Lunchbox Notes any more, its share link stops working, and the person who sent it is told that it was taken down because of a copyright notice, with a copy of the notice (your contact details included, as the law expects).
Someone who is the subject of repeated valid notices loses their account. We look at each case before we close an account, and closing it deletes it as described in our terms.
If your note was taken down
If you think your note was taken down by mistake, or that you were allowed to use the work, you can send us a counter-notice at the same address. It has to include:
- your physical or electronic signature;
- which note or picture was taken down, and where it was before (whom you sent it to, and when);
- a statement, under penalty of perjury, that you believe in good faith that it was taken down by mistake or because the work was misidentified;
- your name, postal address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, outside the United States, any district where Sailstead LLC may be found), and that you will accept service of process from the person who sent the notice, or their agent.
We send the counter-notice to the person who sent the notice. Unless they tell us within 10 working days that they have gone to court to keep the note down, we put it back 10 to 14 working days after we received your counter-notice.
Before you send
A notice or a counter-notice is a legal statement: someone who knowingly misrepresents that something infringes, or that it was taken down by mistake, may be liable for the harm it causes. If you are not sure whether a use is allowed, you may want to ask a lawyer first.
Other reports, about a person, a note or a message that breaks our rules, are made in the app (see Help) or sent to the same address.
